1.1 The Service is made available for download exclusively for Your use and only in accordance with these Terms. Offenders will be processed as rigidly as possible. The license granted under this instrument may not be transferred by You to any third party and is non-exclusive.
1.2 You acknowledge that ownership of the Services and related software belongs to WT SOFTWARE and / or its suppliers, and that such Services are protected by copyrights, trademarks, service marks, patents and / or other proprietary rights and laws . You can not remove any notifications or property IDs from the Services. 1.3 The license granted hereby grants You the right to receive any standard support and upgrade provided by WT SOFTWARE to all users of the Services, generally.
1.4 Any and all content on the websites, software and computer programs associated with the services is protected by copyright and other intellectual property laws.
2.1 You are solely responsible for the content of Your computers, for Your account of WT SOFTWARE and for any transmissions made in using the Services. Your use of the Services is subject to the Terms here set forth and all applicable laws, rules and regulations, including local, state, national and international (including, without limitation, those governing account collection, export control, customer protection , unfair competition, anti-discrimination or misleading advertising).
By using any Services, You agree to: (i) comply with all applicable laws, rules and regulations, including local, state, national, and international laws, rules and other regulations (including, but not limited to, billing, export control, consumer protection, unfair competition, anti-discrimination or misleading advertising); (ii) not to publish, distribute, or make available or transmit any software or other computer files that contain viruses, trojan horses, worm or other harmful components; (iii) not use the Service for illegal purposes; (iv) not exclude from the Service or related software documentation or any site used in conjunction with the Service, legal notices, disclaimers or proprietary notices, such as copyright or trademark notices, or modify logos other than of Your property or that You do not have express permission to modify; (v) not interfere or interrupt networks connected to the Service; (vi) not to use the Service to infringe copyrights, patents, trademarks, trade secrets or other proprietary rights or third party publicity or privacy rights; and (vii) does not transmit illegal, harassing, defamatory, racist, indecent, abusive, violent, threatening, intimidating, harmful, vulgar, obscene, offensive or otherwise objectionable material of any kind or nature. You will never access or use another person's Cloud account at any time without the permission of the account holder. You agree to be responsible for all actions and inactions of your employees and consultants and will endeavor commercially to monitor your employees and consultants. WT SOFTWARE reserves the right to disable Your account or take any other action that WT SOFTWARE in its sole discretion deems necessary or appropriate if WT SOFTWARE has reason to believe that Your conduct during the use of any Services violated the terms of that Section
Some Services provided by WT SOFTWARE pursuant to this agreement require you to use an email address to create a username and choose a password to access Your Cloud account (for security purposes, WT SOFTWARE recommends that your chosen password to the Service is different from the username and password of your computer). WT SOFTWARE does not send emails requesting the username and / or password of a user's Cloud. To keep the Service secure, You must keep all usernames and passwords confidential. Access to and use of the security and / or password protection aspects of the Services is restricted to authorized users only. Unauthorized persons attempting to use any Services may be prosecuted. You agree to carefully protect all of your passwords. WT SOFTWARE does not maintain a database of user passwords; therefore You are fully responsible in case you do not maintain the confidentiality of Your passwords and account information. In addition, You are fully responsible for any and all activity that occurs in Your account. WT SOFTWARE shall not be liable for any loss incurred by You resulting from the use by third parties of Your password, account or public / private key, as applicable, with or without your knowledge. However, You may be held liable for losses incurred by WT SOFTWARE or other party due to the use by third parties of Your password, account or public / private key, as applicable, with or without your knowledge. You agree to promptly notify WT SOFTWARE of any unauthorized use of Your account or any other suspected breach of security of Your knowledge, including if You believe Your password and / or account information has been stolen or otherwise committed. (iii) Software: Netspy Pro software, developed by
WT Software that provides the User with the possibility of control, monitoring and blocking Internet access, as described below: (a) blocking of sites; (b) monitoring keystrokes; (c) monitoring online surveys; (d) reporting on the daily activities of the appliance; (e) monitoring of accessed sites; (f) monitoring of messages received and sent via instant communication tools such as facebook and skype; (g) monitoring of accessed profiles; (h) monitoring through keyword alerts; (i) capturing images from the screen;
2.3 It is strictly necessary for the User to follow the policies made available by WT Software within the scope of this license and shall not misuse the services offered by the Software as well as the Software itself (eg not interfere with the services, using a method other than the interface and instructions provided by WT Software).
3.1. The Software, developed by WT Software, provides the User with the possibility of control and monitoring, as described below and as updated from time to time, according to the document available in Terms of Use
3.2. WT SOFTWARE may make updates to the Software as well as to the Terms and Conditions for the purpose of improving the services provided to the User, which may be done at any time, provided that WT SOFTWARE updates the document in Terms of Use . Once the Software has been updated, the User will automatically agree to all the Terms and Conditions, as amended, as well as with the clauses contained in this agreement, including with respect to such updating.
3.2 Except as otherwise provided, all new features that enhance or extend the services currently offered by the Software will be subject to this license. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WT SOFTWARE EXPRESSLY DISCLAIMS ALL CONDITIONS, STATEMENTS AND WARRANTIES REGARDING THE SERVICE, WHETHER EXPRESS OR IMPLIED, ARISING OUT OF LAWS, COSTS, PRELIMINARY OR OR WRITTEN STATEMENTS, BETWEEN OTHERS. WT SOFTWARE DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, OR FREE OF ERRORS.
WT SOFTWARE ALSO DOES NOT PROVIDE WARRANTIES REGARDING THE RESULTS THAT MAY BE OBTAINED BY THE USE OF THE SERVICE OR THE ACCURACY OF ANY OTHER INFORMATION OBTAINED THROUGH THE SERVICE. YOU UNDERSTAND AND AGREE THAT DOWNLOAD (OR OTHERWISE) OF ANY MATERIAL AND / OR DATA THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR DAMAGE TO ANY COMPUTER SYSTEM OR FOR LOSS OF DATA CAUSED BY DOWNLOAD OF SUCH MATERIAL AND / OR DATA. After the expiration or termination of the Service for any reason, You are no longer authorized to use the Service. You should consult your own legal counsel with respect to the legality of your use of the Licensed Software in the manner you intend to use it before downloading, installing, and using the same. You assume full responsibility to determine if you have the right to monitor the device on which the Licensed Software is installed. WTSOFTWARE (netspypro) can not be liable if the User chooses to monitor a device that the User does not have the right to monitor; nor can WT SOFTWARE (netspypro) provide legal advice regarding the use of the Licensed Software.
